The crypto industry enters September with its biggest legislative bet hanging in the balance: a looming vote on the CLARITY Act, the US market-structure bill that would give digital assets their first comprehensive federal framework. Growing doubts surround whether it can pass before the midterm elections, CNBC reported on September 1.

The bill would divide oversight between the Securities and Exchange Commission and the Commodity Futures Trading Commission, set registration requirements and strengthen anti-money-laundering protections for digital-asset firms.

A critical window

Industry executives and investors who spent years pushing Washington for clearer rules now face a narrowing calendar. Former New York Governor Andrew Cuomo, an OKX board member, told CNBC at the Wyoming Blockchain Symposium that if the bill fails before the midterms and Democrats take the House, the industry could face years of regulatory conflict.

“If you believe there’s a change of power, at least in the House, which I do believe that Democrats will win the House, then you’re going to have a Democratic Congress overseeing an administration… with the regulators making decisions under the scrutiny of a hostile Congress,” Cuomo said.

Why formal legislation still matters

Andrew McCormick, head of institutional and market development at Chainlink Labs, told CNBC that durable legislation provides certainty that survives changes in administrations — something agency-level accommodations cannot guarantee. “If you’re looking to deploy capital and invest… formal legislation can provide certainty,” he said.

Many in the industry are already resigned that the CLARITY Act may not become law in 2026, CNBC reported, even as the September vote shapes up as a critical test of crypto’s political influence.

What this does NOT tell you

A failed vote would not be a return to the hostile regulatory era of 2022-2023. The SEC, CFTC and other agencies have already taken more accommodating positions on crypto without comprehensive legislation, and companies have learned to operate in the current patchwork. The bill’s fate matters most for long-term capital commitment and for venue choices — not necessarily for next week’s price action.

September is the moment of truth for the industry’s Washington strategy. Passage would lock in a durable framework; failure would leave crypto to the mercy of agency discretion and the next election cycle. Either outcome will reshape how the market prices regulatory risk for the rest of 2026.
